Teacher wins reinstatement order

RAWALPINDI:

The Provincial Ombudsperson has taken notice of the failure to implement a decision ordering the reinstatement of a teacher who was unlawfully dismissed by a private school, declaring it an act of maladministration and directing that the order be enforced within 45 days.

According to the case record, the private management of the DIL Foundation School in Ranjali, Gujar Khan tehsil, had dismissed teacher Nabeela Shaheen in violation of the applicable rules. An inquiry conducted by the Deputy District Education Officer, Gujar Khan, found the teacher's stance to be correct.

In light of the inquiry, the Chief Executive Officer (CEO) Education Rawalpindi had issued written orders directing the school to immediately reinstate the teacher, pay all outstanding dues and compensate her for mental suffering. However, the Rawalpindi District Education Authority failed to ensure implementation of its own orders.

Punjab Ombudsperson Ayesha Hamid took notice of the failure to enforce the official orders and directed the CEO Education Rawalpindi to exercise powers under the Ombudsperson Act and ensure implementation of the decision by the private school within 45 days.

According to the ombudsperson's order, the CEO must ensure the school immediately restores the teacher to her position, pays all withheld salaries and outstanding dues in accordance with the law.
