Notices issued on petition against demolition of wall
The Sindh High Court (SHC) has issued notices to the Sindh government, KMC, PECHS, and other respondents on a petition challenging the demolition of a boundary wall surrounding a disputed plot near Hill Park.
During the hearing, counsel for the petitioner argued that Sohail Iqbal Siddiqui is the lawful owner of the plot in question. He submitted that KMC demolished the boundary wall on June 2 without issuing any legal notice and without lawful authority.
The petitioner's lawyer further contended that, according to a letter issued by PECHS, the disputed plot does not fall within the limits of Hill Park and is entirely under the jurisdiction of PECHS. He stated that all land records relating to the property are maintained by PECHS.
The court was informed that KMC had itself issued a No Objection Certificate (NOC) on April 21 for the construction of the boundary wall. Therefore, the subsequent demolition was unlawful and beyond the authority of the municipal body.
The petitioner requested the court to order an inquiry and departmental action against the officials responsible for the demolition and to restrain the relevant authorities from interfering with the property.
