CDA put on notice in One Constitution Avenue case

Division bench of IHC issues notice on intra-court appeal submitted by sub-lease holders of 20 more apartments

ISLAMABAD:

A division bench of the Islamabad High Court (IHC) comprising Justice Azam Khan and Justice Raja Inam Amin Minhas issued a notice to the CDA on the intra-court appeal submitted by the sub-lease holders of 20 more apartments of One Constitution Avenue and has sought its response.

During the hearing of the intra-court appeals of the 20 appellants including former Air Chief Mujahid Anwar Khan and former PCB Chairman Ehsan Mani, the appellants' counsel Lawyer Ali Raza said that the rights of the appellants were affected by paragraph 30 of the single bench decision of the IHC.

He requested the court to declare the rights acquired by the appellants under the sub-lease be legal and effective. He further put forward the appellants' demands, stating that the CDA from should be prevented from interfering with the peaceful possession of the apartments by the appellants and that Paragraph 30 of the single bench decision should be nullified.

Noting the significance of the issue at hand, the counsel pointed out that a Prime Minister's committee had also been formed to look into the One Constitution Avenue case. He also requested the the court to issue an order regarding the protection of the apartment owners in time, before the committee can say that they cannot do anything on May 26 by saying that the next day is Eid. He voiced the appellants fear that the CDA may come to their apartments and ask them to vacate again.

In response, Justice Muhammad Azam Khan said that they were issuing a notice and called upon CDA to present a response on Wednesday.
