PHC seeks answers on missing persons

Court questions authorities on disappearances, summons comprehensive reports

PESHAWAR:

The Peshawar High Court (PHC) has issued notices to the provincial and federal governments on petitions filed for the recovery of 10 missing persons, seeking their response.

During the hearing, Acting Chief Justice Syed Muhammad Attique Shah remarked that authorities submit reports in court stating only that the missing person is not in their custody.

He emphasized on the need of comprehensive reports, covering all aspects of the missing person and why the individuals have gone missing.

The petitions were heard by a single-member bench comprising Acting Chief Justice. As the hearing commenced, Additional Advocate General, Deputy Attorney General Ubaidullah Anwar, and police focal person SP Kamal Hussain Tori appeared before the court.

Acting Chief Justice questioned the police focal person about the rising number of missing persons.

In response, the focal person maintained that many individuals went missing on their own due to personal enmities, debts, or to evade arrest. To this, the Chief Justice remarked that such people seem to be more skilled than the police, adding that law enforcement agencies should have proper knowledge of why a person had disappeared.

He further criticized the authorities for submitting vague reports that merely state the missing individual is not in their custody.

He stressed that reports should be comprehensive and cover all relevant factors. In response, the Additional Advocate General acknowledged the suggestion, agreeing that Station House Officers (SHOs) should submit detailed reports on every missing person, including their character, business, and other relevant aspects.

The court was also informed that some individuals disappear due to bankruptcy, while others fake their disappearances. The bench issued notices to the provincial and federal governments, seeking a response in the next hearing regarding the 10 missing person's cases.

Faisal Javed case

The Peshawar High Court on Monday issued a notice to the federal government on a writ petition against putting of Pakistan Tehreek-e-Insaf leader Senator Faisal Javed's name on the exit control list.

The case was heard by Justice Waqar Ahmed and Justice Sabitullah Khan.

Alam Khan Adenizi appeared for the petitioner Faisal Javed, Additional Advocate General for the provincial government, while Assistant Attorney General Rahat Nahqi represented the federal government in the court.
