ISLAMABAD:

The Islamabad High Court (IHC) summoned the attorney general for Pakistan (AGP) to assist the court on a constitutional matter in the case of Sanam Javed whether she could be arrested in multiple cases over one incident of May 9.

IHC Justice Miangul Hasan Aurangzeb issued a written order after the case hearing. The order stated that Sanam Javed was never punished in any case in the past, but she has been detained in different police stations for more than a year.

The question arises whether Sanam Javed could be arrested in several cases over one incident on May 9, it said, adding that the question was of constitutional importance, so it was also important to determine the manner in which it was dealt with.

In this regard, the order cited relevant precedents from judgements in cases like Sughra Bibi, Sheikh Rashid and Ali Wazir. The court issued a notice to the attorney general for Pakistan, asking him to assist the court on the next hearing.

The court noted that Sanam Javed had been granted interim bail in a case in Quetta, with direction to her to deposit a surety bond of Rs5,000 and ensure her presence in court at the next hearing.

The Islamabad High Court directed the Islamabad police chief to ensure that Sanam Javed was not arrested until the next hearing and also ensure that she was not taken outside the federal capital. Further hearing of the case will be held on July 18.

Pakistan Tehreek-e-Insaf (PTI) activist Sanam Javed was arrested last year following the violence and attacks on state institution on May 9. Since then, she had been arrested multiple times whenever a court granted her bail.

The PTI activist has been under arrest for the last one year.
