Important witness fails to produce in court

ISLAMABAD:

A District and Sessions Court in Islamabad while giving the benefit of the doubt to Shahnawaz Amir – the primary suspect arrested for the murder of Canadian woman Sarah Inam – acquitted him in the illegal Kalashnikov recovery case on Monday.

According to the ruling issued by the court of Judicial Magistrate Umar Shabbir, it has been said that the prosecution miserably failed to prove the charges against the accused.

“There were several uncertainties in the evidence presented by the prosecution. The accused is entitled to the benefit of the doubt,” the court upheld.

“Constable Tariq, who sent the complaint of the case to the police station, was not produced in the court as a witness.

Failure to produce such an important witness has consequences under the Qanoon-e-Shahadat,” the order said, pointing out the failure of the prosecution to produce a private witness. The court ordered the release of the accused in the Kalashnikov recovery case.
