New CJ brings hope for change

SC justice hints at introduction of a judicial reforms agenda by CJP-designate Justice Qazi Faez Isa

As Chief Justice of Pakistan Umar Atta Bandial is set to doff his robe, Supreme Court judges appear optimistic about the prospects of positive change within the institution following the appointment of his successor, Justice Qazi Faez Isa.

The hopeful sentiments were shared during an interaction with SC judges over refreshments after the start of the new judicial year. "On the very first working day, a message will be conveyed by the new CJP through his actions," remarked the SC judge confidently.

One of them expressed hope that despite the limited duration of his tenure, Justice Isa would initiate reforms, while another hinted at the introduction of a judicial reforms agenda by the new CJP, Qazi Faez Isa.

However, lawyers also anticipate that the biggest challenge for the incoming CJP will be fostering unity within the institution. It is expected that Justice Isa will soon summon a full court meeting.

During interactions with lawyers and media, CJP-designate Justice Isa appeared composed and made it clear that the constitution would be his sole focus.

Earlier, Justice Isa also attended a farewell dinner arranged by Justice Munib Akhtar and two other judges belonging to Sindh in honour of outgoing CJP Bandial. His participation is being seen as a positive development in light of recent internal clashes within the SC.

Other judges belonging to other provinces are arranging farewell dinner on Tuesday (today).

Controversies in CJ Bandial's tenure

Controversies have surrounded the outgoing CJP Bandial throughout his tenure. Senior lawyers argue that while some former chief justices had damaged the country, Bandial remained more controversial due to being questioned by his fellow judges on several issues.

Rather than resolving internal conflicts, CJP Bandial relied solely on like-minded judges, neglecting the formation of a full court for any high-profile cases.

A lawyer lamented that Bandial was unable to handle judges with differing viewpoints on constitutional matters.

As internal divisions among judges have deepened throughout the past year, the authority of the top court has been undermined, and state institutions have failed to comply with several SC orders. The conduct of fellow judges has been called into question, and no full court meetings have taken place.
Senior judges also remain divided on filling vacant positions in the apex court, with one position still unfilled.

It is noteworthy that during his address, outgoing CJP Bandial expected that the SC would maintain the supremacy of the constitution under the leadership of Justice Isa.
