The Peshawar High Court (PHC) on Thursday amended the injunction order on byelections of the National Assembly across the country, limiting it only to the extent of Khyber-Pakhtunkhwa while allowing them to be held in other provinces.
The decision came after a writ petition was filed by Shaukat Ali and others regarding the election of the Nankana Sahib seat of the NA. A two-member bench of the PHC comprising Justice Ishtiaq Ibrahim and Justice Waqar Ahmed heard the petition. In the petition, it was requested that the court lift the injunction on by-elections in provinces other than K-P, as the court had previously issued a restraining order on by-elections of the NA in K-P, Punjab, and Sindh.
After hearing the arguments, the court allowed NA by-elections to be held in other provinces while extending the ban in K-P. This decision clarified the scope of the injunction and allowed by-elections to proceed in provinces other than K-P.
