Septuagenarian moves court against son in property dispute

KARACHI:

The Sindh High Court (SHC) on Friday ordered to hear on priority basis a case relating to property dispute and forced eviction of a 74-year-old woman from her house in Defence Housing Authority (DHA) Phase V.

A two-member bench headed by Justice Naimatullah Phulpoto heard the petition filed by 74-year-old Nusrat Ahmed through her counsel Saleem Advocate.

Nusrat's counsel submitted that his client's son Kamran Ahmed and his wife Tehmina live with her in the same house. However, they have been trying to take over the property and evict the septuagenarian even though she is the rightful owner of the property.

He said that his client was assaulted twice by her daughter-in-law on which she had filed an application with the deputy commissioner.

He told the court that the deputy commissioner of district South had ordered the son and daughter-in-law to vacate the house, but they had challenged the decision in the sessions court.

After the sessions court rejected their plea, they had moved the high court over it.

The petitioner's counsel requested the court to dismiss the case of Kamran and Tahmina. He also urged the court to hear the case on proprity basis considering the woman in question was a senior citizen. The court consented to hearing the case on priority basis and fixed the hearing after two weeks.
