SC turns down Monal Restaurant's appeal against stay

Justice Ijaz-ul-Ahsan remarked that if they wanted stay to be withdrawn, a formal petition should be filed

The Supreme Court on Friday rejected a petition seeking revocation of the stay order issued by the Islamabad High Court against Monal Restaurant. A three-member bench headed by Justice Ijaz-ul-Ahsan heard the appeal against the closure of Monal Restaurant.

During the hearing, Justice Ijaz-ul-Ahsan remarked that if they wanted the stay to be withdrawn, a formal petition should be filed. The wildlife board lawyer said a petition would have to be filed to review the stay order.

Justice Ijaz-ul-Ahsan said that “do what you think is appropriate”. The wildlife board lawyer told the court that Monal's entire sewage was spreading in Islamabad. Monal Restaurant lawyer Makhdoom Ali Khan said that the court was being misled in this regard. Justice Ijaz-ul-Ahsan inquired whether a detailed decision of the high court had been announced.

On which the lawyer Monal Restaurant told the court that no detailed decision was yet to come and an intra-court appeal was also pending. The Supreme Court rejected the petition seeking revocation of the stay order and adjourned the hearing indefinitely.
