Sindh High Court judge Justice Arshad Hussain recused himself from hearing a petition against a special anti-terrorism court decision regarding separation of key witnesses in the case of treatment of terrorists in Dr. Asim Hussain's hospital.
A bench comprising Justice KK Agha and Justice Arshad Hussain heard the plea of Dr. Asim Hussain against the separation of key witnesses by the special ATC in the case of treatment of terrorists in the hospital.
Amir Naqvi, counsel for petitioner Dr. Asim Hussain, argued that the ATC had removed five key witnesses from the case on the request of Rangers counsel. The special ATC granted the Rangers' request without giving notice to the accused. The witnesses belonged to Zia-ud-Din Hospital. "It is requested that the decision of the special ATC be quashed," the counsel argued.
Justice Arshad Hussain, who was present in the bench, recused himself from hearing the petition. The head of the bench directed to transfer the petition to another bench for hearing.
The court directed to set December 15 for hearing by the second bench.
The case was registered against Dr Asim Hussain and others in 2015 on the complaint of Rangers.

A two-judge bench headed by Justice Zafar Ahmed Rajput heard the petition. The petitioner's counsel stated that construction work on Gohar Complex is in full swing. It has become a 12-13 storey building.
The counsel for Gohar Complex argued that arguments should be sought if the petition is admissible.
Earlier, a similar petition was filed by an NGO. The court had granted the request for urgent hearing.
The court directed that the hearing of the petition be held in the first week of February.
Illegal portions case
The Sindh High Court issued notices to the DG Sindh Building Control Authority (SBCA) and others on the petition against construction of portions in North Nazimabad and ordered the builder to stop construction immediately.

Petitioner's counsel Waheed Hussain Advocate stated that portions are being constructed on residential plots in Block-C. The portions will affect the rights of the residents of the area. Residents of the area will face other problems including sewerage and parking. Builders should be instructed to stop construction and SBCA may be directed to take action.
The court issued notices to DG SBCA and others and ordered builders Abbas Baghichawala and others to stop construction immediately.
