Expressing wonder at how a trial court had not completed the legal proceedings against a jailed police official despite a lapse of two years, the apex court on Tuesday summoned a report from the lower court on the application of Junaid Khan who is in jail for the past couple of years.
Khan, who was working as a deputy inspector general of police in Gilgit-Baltistan in 2019, is accused of posting online his wife’s inappropriate pictures.
His application was heard by a three-member bench of the Supreme Court (SC), headed by Justice Mushir Alam.
The petitioner’s lawyer complained that the suspect had been imprisoned for the last two years even though most charges levelled against him were bailable as per the law.
Justice Sardar Tariq questioned the prosecution as to why the case had been pending for the past two years and when was the charge sheet filed.
In his response, the additional attorney general said the trial against the suspect could not be completed at the lower first because of a bail application filed by the suspect. Later, a petition was filed under Section 265 in the case, he added.
At this, Justice Sardar Tariq Masood questioned that why the trial court had consumed two years on settling two applications in the case.
Justice Mushir Alam said a report should be summoned from the trial court to determine who was responsible for the delay.
