Asghar Khan case could not proceed due to lack of evidence, FIA tells SC again

During hearing in Supreme Court, defence ministry submits report on progress in implementation of 2012 case verdict

ISLAMABAD: The Federal Investigation Agency (FIA) on Monday once again pleaded the Supreme Court to close the 2012 Asghar Khan case for "lack of proof".

During the course of proceeding in the apex court, the FIA maintained that due to lack of evidence the case could not proceed in the court of law.

The federal agency also stated in a report that it was unable to find enough substantial evidence to take the case forward and statements of all important witnesses who were available had been recorded.

The FIA said it had also interviewed two journalists – Mujeebur Rehman Shami and Habib Ikram – and also investigated the main witness, Brig (retd) Hamid Saeed, as well as Advocate Yousaf Memon, but to no avail.



The defence ministry also submitted a report on the progress in implementation of the Asghar Khan case verdict, saying that it had constituted a court of inquiry, which had recorded the statements of six witnesses. According to the report, the ministry was looking for more witnesses.

The ministry report said that a Court of Inquiry had examined all proofs and civilians associated with the case, adding that efforts were being made to bring the matter to its logical end as per the rules and regulations.

Earlier in December last year, the FIA had suggested to the Supreme Court to close the inquiry for initiating action against politicians who allegedly received money from Inter-Services Intelligence (ISI) ahead of the 1990 general elections.
