Committee seeks details on courts merger

Senate body briefed on compliance of LHC verdicts regarding various ministries

ISLAMABAD: Senate Committee on Legal Reforms on Wednesday demanded details from the Ministry of Law on merging special courts with general courts.

The meeting held under the chairmanship of Pakistan Peoples Party (PPP) Senator Farooq H Naek demanded details from the relevant ministry on merging the special courts into general ones and directed for strong, reasonable basis for the merger to be brought before the committee

Secretary Health also briefed the committee regarding the Pakistan Medical and Dental Council (PMDC). The panel was informed the PMDC is a 17-member council which is currently incomplete as three provinces namely Punjab, Sindh and Balochistan are yet to send their nominations for formation of the council.

The committee was further told after completion of council members, its president will be elected and for the time being a caretaker committee is looking after the council’s affairs.  The Senate committee directed to present PMDC Ordinance before parliament at the earliest.

Meanwhile, the committee was also briefed on compliance of judgments of Lahore High Court (LHC) regarding various ministries. The participants discussed compliance of LHC judgments on Ministry of Defence, Ministry of Law and Justice, Ministry of Health and Ministry of Climate Change.

Jurisdiction of courts extended to ex-Fata

Director General Military Cantonments of Lands apprised the committee the department had gone into intra-court appeal against decision of the court and arguments in the case are in progress.

Similarly, Secretary Law and Justice also informed the ministry had approach higher court of law on a LHC judgment declaring sections 10, 11, 12 and 15 of Federal Ombudsman Institution Reforms Act 2013 as ultra vires of the constitution while additional secretary climate change told the panel that following LHC orders, a Standing Committee on Climate Change has been established.

Subsequently, the committee decided to discuss Muslim Family Act 1961 in the next meeting.
