SHC acquits man sentenced to 12 years by anti-terrorism court

KARACHI: Father of Naqeebullah Mehsud, Muhammad Khan, has filed an application in the Sindh High Court (SHC) to cancel bail granted by a lower court to former Malir SSP Rao Anwar and others in an illegal arms possession case.

The application was filed by Advocate Faisal Siddiqui on behalf of Khan. According to the application, the anti-terrorism court (ATC) concerned had shown bias in the case due to which SSP Anwar and others were given concessions that they did not deserve.

The applicant also maintained that the aggrieved party was not heard while deciding on the bail plea of SSP Anwar. The SHC was requested to cancel bail of the SSP so that he could be arrested and transferred to jail.

Man acquitted

The SHC also approved the appeal of a suspect against 12-year term handed down to him by an ATC in a case pertaining to robbery and crossfire.



A two-member bench heard the appeal of the convicted man, Ameenullah. The prosecutor maintained that police had conducted a raid on a tip-off to arrest robbers, however, many of them escaped under the cover of fire. According to the prosecutor, the convict was one of the robbers who was arrested and later convicted by the ATC.

However, the defence lawyer argued that his client was not among the robbers but instead he had helped the law enforcement agencies (LEAs) in carrying out the raid. According to the lawyer, the police had falsely implicated him. It was argued that if police's stance was admitted, no local would ever cooperate with LEAs to arrest criminals.

Annulling the ATC verdict, the SHC acquitted the suspect and issued orders for his release.

Corps commander attack

On the appeal of suspects who were sentenced to death in the corps commander attack case, the SHC directed their lawyers to come prepared at hearing on September 19.



A two-member bench adjourned hearing due to the absence of lawyers of the convicts.

According to a prosecutor, 11 suspects, Ataur Rehman alias Ibrahim Shahzad Bajwa, Yaqoob, Uzair Ahmed, Shoaib Siddiqui, Danish Imam and others, had also attacked the Gulistan-e-Jauhar police station in 2004, in which five police officials were killed. They have been sentenced to death in the 2006 case of the attack on then-corps commander Ahsan Saleem Hayat.
