Custody Row: Court gives unmarried parents another chance

LHC gives parents another chance to reach an out of court settlement in case of minor son of two Canadians.

The Lahore High Court, on Thursday, while hearing the custody case of a minor son of two Canadians gave the parents another chance to reach an out of court settlement by today.


On Thursday, the mother Anita Desai’s lawyer, Advocate Aftab Bajwa, told the court that the parties had failed to reach a consensus. Respondent Jahanzeb Niazi’s lawyer Binyamin Chaudhry told the court that almost all Desai’s conditions had been accepted but she was also demanding reimbursement for travelling to Pakistan from Canada for the child.

Bajwa said his client was demanding half the expenses. Chaudhry challenged the jurisdiction of the court and claimed the child had become a Pakistani citizen.

The justice did not entertain this argument saying Paksitan was not the birth place of the child. Bajwa said the custody of minors should be granted to mothers.

He said the child could not have the father’s name as the couple had never been married.
