The Lahore High Court on Monday granted pre-arrest bail to a man accused of raping a 10-year-old girl, after the victim changed her testimony and told the court that the actual rapist was her father.

The father was the complainant in the rape FIR, in which he had also accused the mother of consenting to her daughter’s rape. Justice Chaudhry Iftikhar Hussain took no action against the father or the mother. The girl came to the courtroom with her mother and left with her.

According to the FIR lodged at Wahdat Colony police station on August 22, *Muhammad Aisam raped 10-year-old *Mariam with the consent of her mother. Mariam had backed up the father’s version in testimony at an earlier bail hearing.

But appearing before the court on Monday, the girl said that her father had raped her several times and threatened her and bribed her not to tell anyone. She said that Aisam had not raped her.

In the FIR, the father had alleged that his daughter had told him on August 16 that while he was away from home, her mother had invited two boys – Aisam and Mamoon – to their house. She was quoted as saying that the latter had slept with the mother while the former had raped her. According to the investigation record, Mariam was given a medical examination and rape was confirmed.

Aisam in his bail application submitted that he was innocent and the girl’s father was trying to blackmail him.

On December 10, Additional Sessions Judge Muhammad Rafiq had dismissed Aisam’s plea for bail after Mariam testified that the charges were true. “The medical report supports the version of the complainant,” reads Rafiq’s order in the case. “The complainant is of 9-10 years. Her statement at this stage cannot be discarded. No [malice] is attributed to the complainant. The bail application is dismissed.”

    Denial is going to change nothing. Take it for what it is. So what if it wasn’t her father? The fact is that a 10-year old girl was violated in Pakistan.

    I am speechless. This is something only a beast can do, and even beasts don’t copulate with their minor young. This father,if found guilty, should be made an example of justice. And the poor girl must be protected. Where is Mr. Rana Sanaullah who announced a reward of 25 acres of land for the cricketers of they won against India? Will he not muster some moral courage and give thsi land to the affected girl and other victims like her? But maybe, we may fear that then such rapes may really start with the consent of teh family. Oh man! There is no hope for poor victims!Recommend

In this particular case, in both sides on person is a CULPRIT, how can a mother let this happen? IF at all justice of any kind exists in this country both parents (if found guilty) must be given most painful punishment. I believe media instead of diverting attention towards political dramas SHOULD point out such social evil doings.Recommend

    sohail – incest is a human curse, it occurs in every society, including islamic. denial will only lead to further destruction of innocent lives. child molesters rely on people like you, who would rather not discuss it openly but sweep it under the carpet. if anything, we need to confront it head on.

    we can cure this cancer by shining the light of knowledge on it- such disease thrives in denial, and abhors daylight which acts like a disinfectant against it.

    somewhere, someplace a young girl or boy may read this article and gain courage to confront their tormentor who, per social scientists, is more than likely a close family member or family friend.

    indeed, i would urge the vernacular press to publish this story, not only in pakistan, but every south asian language. incest cuts across ethnic, religious and socio-economic categories, and we can stop it by talking about it.Recommend

    Heyyy every one pls listen. dont come to the conclusions. Try to digest it that INCEST exits. being a civil society member and working for sexual abuse survivors I dealt with number of incest survivors. Some became pregnant. some cases are in Pakistani courts.06 April 2011 another urdu newspaper of Lahore reported a attempt rape(incest).These survivors are in real pain. Remember in rape survivor can leave that place but in Incest she has to live in same house. In our society relation and respect are part and parcel. Also we never noticed that why women or girls avoid some relatives even passing salam sometimes. Offenses like these are never ever welcomed in any society. Accused should be produced for trial in courts at any cost. We cannot generalize that if it is Islami jumoria-e-Pakistan then such crimes cannot occur here. Accept the reality and condemn it with logic and support these survivors. Believe me it is not a blame game. I wish in June 2011 i would able to share the facts, reasons (psychological as well as legal) on this issue. Recommend
