
A consumer court on Wednesday disposed of a petition after the petitioner and the respondent agreed a settlement in a case for delivering furniture by buyer found unsatisfactory causing a delay in his daughter marriage.
The complainant, Aga Jahangir Khan, had filed a petition against Neelaam Ghar, located at Workshop Stop near Jinnah Hospital, saying that he had bought a bedroom set consisting of a bed, a dressing table and a showcase from them on February 8 for his daughter’s wedding. He said he discovered that the quality of the wood was not good and the paint started coming off within a week. He also said that the size of the bed was smaller than the sample he had been shown at the shop.
Khan said that his daughter’s marriage had to be postponed for the same reason.
He had demanded Rs57,000 as damages (Rs20,000 actual price of the furniture; Rs5,000 for legal fees; Rs2,000 for transport and; Rs30,000 for mental torture).
He said that he had visited the respondent’s shop several times and asked them to replace the furniture, but they had refused. He said they told him the money would be returned only after the furniture was sold to another customer.
He told the court that he could not afford to purchase new furniture and had to extend the date of the wedding, which had been scheduled for February 28.
The court then issued a notice to the respondent for March 30, where the respondent agreed to pay the actual price of the furniture, Rs20,000.
Muhammad Jamil, who appeared on behalf of the respondent, said that the furniture was manufactured using quality wood. He said it was the petitioner’s responsibility to check the product properly before approving it and paying the price.
