Double murder trial: Davis sent on judicial remand

American national Raymond Davis has been sent on a 14-day judicial remand by a Lahore court on Friday while investigations reveal the murders were not in self defence, said police officials.

Deputy Superintendent Police Old Anarkali Safdar Raza Kazmi produced the hand-cuffed accused in an armoured vehicle in judicial magistrate Model Town Muhammad Aneeq Anwar’s court, amid tight security.

Investigation officer of the case Inspector Munir Ahmed informed the court that the accused has confessed to his crime during interrogation and evidence in this regard has been made part of the case record.

Ahmed also submitted provisional charge sheet of the accused and requested the court to send Davis to jail on judicial remand as his ongoing 14-day physical remand has elapsed under the law.

Meanwhile, Advocate Hassam Qadir appeared on behalf of Davis and submitted an application, contending that his client enjoys diplomatic immunity. He requested the court to hold in-camera proceedings.

The court sought comments from the prosecution department by February 25 on the plea of Davis’ counsel. On the issue of Davis’ immunity, the court said the matter is pending before the Lahore High Court.

The judge directed police to produce Raymond again on February 25 along with copy of final charge sheet.

Meanwhile, Capital City Police Officer (CCPO) Lahore Aslam Tareen said Davis committed a premeditated and cold-blooded murder.

Addressing a press conference at his office on Friday, Tareen said the investigation led the police to the conclusion that Davis is guilty of murder.

The police submitted the provisional charge sheet requesting the court to take action against Davis under Section 302 of Pakistan Penal Code, Tareen said.

Divulging further, Tareen said no finger prints have been found on the triggers of the pistols recovered from the two men killed by Davis and tests showed the bullets remained in the magazine of their gun and not the chamber. He added that according to eyewitness accounts, Davis directly shot at the two men and kept shooting even when one of them was running away, implying the act was not in self defence.

Regarding the suspects who killed the third motorcyclist, Tareen said they have still not been handed over to the police.

“Complete charge sheet would be submitted in the court after the recovery of other vehicle and custody of other accused men,” he dded.

Meanwhile, activists of the banned outfit Jamaatud Dawa (JuD) held a protest rally in conjunction with Anjumane Tajiran Hall Road on Friday, demanding the government hang Davis.

JuD speakers at the rally vowed to continue protests across the country.

Meanwhile Tahafuz Namoos-e-Risalat Mahaz (TNRM), a group of eight religious parties of the Barelvi school of thought, has stopped protesting against the government after its assurance to not amend the blasphemy laws, said its spokesperson Ziaul Haq Naqshbandi.

    Why is so much time being wasted on this subject? We still have no clue who killed BB…..and another suicide bomber blew himself up (this time 14 years old) at an Pak Army installation YESTERDAY….killing 27 and wounding 42 according to reports.

    The priorities of the media are severly impacting the tide of public opinion. On any given day since this Davis case….there have been articles published and placed in the headlines, with the story changing each time. Yet we know for certain that suicide bombers are blowing up as many people as they can on any given day in any given city in Pakistan. What is being done to place a priority on eliminating terrorism?

    The media needs to do its part by creating pressure on the goverment to make anti-terrorism a PRIORITY. More time and effort needs to be spent on terrorist attacks and the victims families and what they are going through.Recommend

    Now, it seems to me ‘the name of game’ it looks Punjab Govt. is not handling the case tactfully but want to make example/impression to Pakistani peopes ,nobody is above laws, in humble view most of our leaders , should know this … this could lead to fools paradise.
    It will shameful to all of us, to swallow our words in the end .US is claiming diplomatic immunity , this should be verified by SC and then issue persuaded if and when SC decides , accordingly.. Recommend

    The case of Raymond Davis is a litmus test of our Government although beggars are never be chooser, we are unfortunately the beggars, sooner or later the diplomatic immunity will be offered to Raymond by our corrupt politician because they are only puppets. However, if Government sustains this pressure by American then we should consider it as public pressure and should continue to pressurize Government to make good governance in country. Recommend

    This is patent stupidity. we beg American for aid and on the same note seem annoyed when they make demands from us.
    If we taxed the rich feudals, land lords and imporved education and the economy with the money that came with it we would not be in this position.
    The problem is the politicians are ruining this country. If you ask them to tax the elite and rich they refuse, instead they go begging to the IMF and Americans. Then they make a show of being a sovereign country by refusing to hand over this chap to their ultimate pay masters. For them the current circumstances are just fine. They get ever richer every day and put on a play in the national assembly to keep the masses fooled.
    I wish the Americans pull their aid very soon. Then I want to see where this great (sham) “deomocratic” government get’s it’s money from. I think they’ll slash development budgets even further but they’ll continue not to pay an iota in tax because they are all liars. (This has been proven multiple times). Recommend

    Which statement of Punjab Police is true, the statement made on first day of incident or this one. The witnessess on that day were telling different story and now different witnesssess have come at the scene to tell another story. One thing Punjab police is forgetting that every thing is on video tape and in court they will be hiding their faces. Another proof that our investigators are the reason why terrorists cannot be punished. Those who are praising Punjab Police must be joking.Recommend

    The matter is not that serious that US will part its ways with Pakistan and launch an economic and physical attack on Islamabad. Actually Pakistan is strategically very important for US and its interest. This is the issue of justice and Vienna Convention 1963 section 41 states that in case a grave crime of a consular official in the receiving state the immunity will not be allowed. And this Raymond Davis is not even a consular official. Therefore we should wait for what is happening.

    Pakistan government is handling the Davis case very wisely and legally. However, extra security precautions to be taken by the Punjab government for ensuring personal security of Davis and to prevent any subversive act from some unfriendly country to get the double-murder to embarrass Pakistan.Recommend

    @Abbas Khan: I agree with you because I myself saw on the very first day those witnesses who claimed that Raymond Davis did all this in his self defense because those shot were pointing their guns at him and were trying to stop his vehicle by force. All are aware how people are kidnapped for ransom or get robbed in daylight. He was a foreigner so he was extra alert keeping in view the mob justice and lynching people. Moreover he was also attached with USA mission. Yes heart goes for that guy who was crushed by their vehicle but they had no other alternative and had they not done so all those in the other car could have been killed by those who are well known for their hate for Americans. Government in Punjab and their hardcore friends are not only playing with the whole situation but also putting the whole country in danger of being isolated from rest of the world. So far the investigations carried by the Police seems to be joke according to video now being aired on different channels. The Punjabi English which they were speaking with Raymond Davis shows are quality of investigation “this is Nestle di botle” and were also cracking some jokes for which they are well known. In fact the people at the helm of the affairs in Punjab should have taken Center in confidence before filing any FIR. Now since they did all in haste so let the whole country face some classical music on foreign relationships.Recommend

    after reading the people comments, my conviction is higher than before that our biggest enemy is not america, israel or india but the “slave mentality” of our people and mostly educated one are showing slave mentality, in this case people giving hypothetical comments to defend davis shows their slave mentality.

    by virtue of this case i am happy that now its easy to identify the people the who are suffering from syndrome of inferiority complex and slave mentality.Recommend

    Article 41

    Personal inviolability of consular officers

    Consular officers shall not be liable to arrest or detention pending trial, except in the case of a grave crime and pursuant to a decision by the competent judicial authority.
    Except in the case specified in paragraph 1 of this Article, consular officers shall not be committed to prison or liable to any other form of restriction on their personal freedom save in execution of a judicial decision of final effect.
    If criminal proceedings are instituted against a consular officer, he must appear before the competent authorities. Nevertheless, the proceedings shall be conducted with the respect due to him by reason of his official position and, except in the case specified in paragraph 1 of this Article, in a manner which will hamper the exercise of consular functions as little as possible. When, in the circumstances mentioned in paragraph 1 of this Article, it has become necessary to detain a consular officer, the proceedings against him shall be instituted with the minimum of delay.

    After reading through posts and listing to the news everyday. I guess we are missing out important points, which are not been disclosed or I may have missed them. Why did he only shot these two Pakistani? Why not another 8? Glock 9mm can have minimum 12 rounds. With his precision he could have shot more people to safe himself instead of running away, with immunity he could get away with anything, the question is why these two?

    There has to be other side of the story which we as a nation will never be told. What was he doing in Mozang area, why was he travelling in unmarked Lahore reg. car? If he is claiming immunity, why wasn’t he travelling in a Consulate reg. car and why his passport visa states Business Visa? Obviously, Pakistani Embassy in USA must have more details on him when issuing visa. Finally, are diplomats/ foreigner allowed to carry weapon outside the designated area?

    We in Karachi face snatching and mugging almost everyday with Police standing by and doing nothing and it all happens in broad daylight. People carrying licensed weapon are bothered more by the police then one carrying unlicensed one! We as a nation do not respect our system everyone is bothered about there own pride. I am hardly concern about Davis everday there innocent people being shot by there own bothered Pakistan and FIR is logged with unidentified shooter , who is this unidentified shooter Pakistani and how many Pakistani are concerned about it “Zero”.

    I guess lot of people are wasting time on Davis issue let the Juctice system decided. Please use your energy and focus on what we can as a nation to put things right in our country and educate people to follow system which are in place and improve them.

Are you aware of what circumstance would be if you don’t release Ray Trade limitation, Cancellation of Aids, and remember prices of sugar rice and other stuff in 1998 and compare it today at that time you were not threat to US National Security by not releasing Ray you will be problem for America, we have to make decision not by heart but by brain.

    @Shahzaib Syed: We have to start from somewhere, at this point only our Judiciary and its system is putting things right. I hope you are not expecting our illiterate Politian to make literate decision! We as Pakistani and as a nation have been surviving on aid from so called friend from a very long time this aid has created a huge burned on us and our generation to come. The west will gradually tighten the rope around us by putting more pressure until we give up our nuclear assets. They are trying their best to bring nation on the street create internal war by imposing their polices on our country and later when things go out our hands they will be the first to say that Pakistan is a security risk and we will end up Just like Iraq. They talk about Geneva and Vienna convention when only when it suits them. Has any body in the world raised a question or brought Senior & Junior Bush to court for killing million in Iraq , The answer is no! Whereas they brought Milosevic for killing people in Kosovo.

    Thanks to Allah, we have a 160 million plus spirited talented people, our country is rich in resources in every way with great spirited people. We need right honest hard working Leaders to guide the nation to right path and we as a nation to follow them to put our Countries flag at the top.

    I am hardly concern about RD. I am more concern of what we are leaving behind for our new generation. Recommend
