The bench heard a writ petition on Friday. The petition was filed by Muhammad Ismail Khalil of SDA through his counsels Mian Mohibullah Kakalkhel and Mian Saifullah Kakakhel. The bench was informed that SDA was dissolved through an ordinance.
Justice Musarrat Hilali, who headed the bench, asked what led the government to pass an ordinance when the assembly was in session. The petitioner’s counsels argued that the ordinance was beyond the competence of the issuing authority. They said it was issued on the CM’s orders. As a result, SDA employees were left with no other option but to approach the court.
