Divorce over the phone

Letter November 16, 2010
Even after termination of marriage by such effective talaq, there is no bar on divorced wife to remarry same husband.

ISLAMABAD: This is with reference to the report in your newspaper of November 16 titled "Talaq over phone deemed valid" (November 16) in India, I would quote Section 7 of the Muslim Family Laws Ordinance, 1961. The ordinance has not been held repugnant to the injunctions of Islam and provides that no talaq pronounced, in any form whatsoever, shall become effective unless a period of 90 days has passed after a written notice of such pronouncement has been delivered to the Chairman of the Arbitration Council, with a copy provided to the wife, and all necessary steps taken to bring about reconciliation between the parties have failed.

Moreover, even after the termination of marriage by such effective talaq, there is no bar on the divorced wife to remarry the same husband, without an intervening marriage, with a third person.
