
KARACHI: Kaiser Bengali’s article of January 21 titled “Memogate contradictions” was absolutely brilliant.
The points raised are pertinent and need to be addressed if justice is to be seen to be done. Is it that easy to forget the scuttling of democracy in the Maulvi Tamizuddin Khan case or the grant of sanctity to a military takeover in the Dosso case, or the judicial murder of Zulfikar Ali Bhutto?
The fact is that the sanctioning of legality to an overthrow of a duly elected government by the military continued right up to the Pervez Musharraf era. Several recent decisions of the Honourable Court are difficult to comprehend. For example, the decision to bar Husain Haqqani from leaving the country even without hearing him violates a basic maxim of law that no one shall be condemned unheard.
