The verdict was passed after a private complaint was filed under Section 22-A and 22 -B read with Section 25 of the Criminal Procedure Code (CrPC) by advocate SM Tahir Ali, father of the deceased Hafiz Syed Hamza Tahir.
The applicant, making Dr Farooq Mamji, Dr Abdul Sattar Rajput, Dr Sarwar , Doctor Hina and male nurse Khawar respondents, alleges that his son was admitted to the hospital as he complained of pain in his right shoulder and arm on November 3, 2009. The boy, a body-builder, went into a coma the next day and breathed his last breath on November 5, 2009.
The patient’s condition deteriorated due to negligence and an overdose of medicines, the complainant alleged.
On Friday, the Additional District and Sessions Judge disposed of the application and directed the complainant to visit the concerned police station and register the FIR. The SHO concerned was directed to record the statement of the complainant and if any cognizable offence is recognised, the SHO was directed to incorporate such a statement under Section 154.
