Flawed investigation by the police impact decisions taken by the court, said Peshawar High Court Chief Justice (CJ) Dost Muhammad Khan on Tuesday. This hands an advantage to accused in many cases, added CJ Khan.


During a bail application hearing of Bostan alias Bostany, CJ Khan remarked the police find clues during investigation but they do not follow them. The court does not want to release criminals from prisons who violate the law and bring anarchy in the society, said the chief justice. The court gives decisions based on law, he added.

The single-member bench was informed by the petitioner’s lawyer Advocate Abdul Latif Afridi that the police raided a house, allegedly owned  by the accused, within the jurisdiction of Shal Qabol police station on July 7.

Weapons and narcotics were recovered in the raid. However,  Afridi added, his client was being deliberately indicted as the police did not complete workings on who the house belonged to. After hearing arguments from both sides, the bench ordered the release of Bostan on bail.
