On December 25, last year, Shahzeb Khan, 20, was gunned down by Shahrukh Jatoi, who was accompanied by his friends, Siraj and Sajjad Talpur. The young men had a fight after the Talpur’s servant, Ghulam Murtaza Lashari, teased Shahzeb’s sister.
An anti-terrorism court had handed death sentences to main accused Shahrukh Jatoi and Siraj Talpur and life-long jail terms to Sajjad Talpur and Ghulam Murtaza Lashari on June 7.
Today, Shahzeb’s parents - DSP Aurangzeb Khan and Ambreen Aurangzeb – have decided to pardon the culprits in the “name of Allah.” They have further requested for their release.
Court to take up compromise plea
An anti-terrorism appellate bench of the Sindh High Court will take up the compromise plea along with appeals filed by the four convicts against their conviction.
No date for this hearing has been fixed so far.

Dear Lord,this world can be very sad for some people. No parent deserves to lose there son at a young age. But look at the strength of these parents.
It is a fact that rich and powerful people are using there money and influence to make the lives of common people harsh but they tend to forget that death comes to everyone including them

The country needs parliamentarians to pass a legislation that gives permission to the government to intervene and not pardon the criminals.The final decision should reside by the government. the government should give a fair chance of trial and then convict. Shahruk Jatoi knew from the day one when he was brought back from Dubai that he may be procecuted, but he will never be hanged, as his father can bribe any one in the country and can purchase any body as he has tons and tons of money.
With this example set by the rich for the poor, it has now become a fact that rich can kill any body in Pakistan at any time and then after few months he will be released from the jail on certain ground and can walk away freely.
According to Geo TV report, Shahzeb's parents has taken 35 millions from Shahrukh Jatoi's father and they will be leaving for Austrialia any day.
I do not any more hear the old phrase now-a-days that: "Zulm Phir Zulm Hai, Bartha Hai Tou Mit Jata Hai, Khoon Phir Khoon Hai, Tapkey Ga Tou Jum Jaey Ga".

A number of passionate arguments have flown across the media screens eversince the news of the family pardon under Qisas and Diyat laws surfaced. It is an obvious case where our heart feels that criminals most vile have escaped justice through perfectly legal means available under the law of the land and (apparently) supported thru divine injunctions. Have the parents simply exercised their God given right to the best of their current situation or were forced to betray themselves in a further test so cruelly imposed by the law by not refusing to exercise their divinely granted power to forgive. One has to sympathize with a family that not only had to cope with the loss of a son but also then have to charter a course in a torturous maze of laws that ultimately pits their outrage against the cold realities of the society they exist in. A permanent change of residency abroad is perhaps proof enough that their safe existence was not possible anymore in the land where the legal system had allowed them a right to pardon in the first place. So does this legal system make the weak more vulnerable by giving them this right of pardon? The powerful forgiving the weak is definitely noble, the weak and poor pardoning the powerful and rich, is that really justice?
It appears that the only balm left to the weak party is the hope that this act of kindness will buy them salvation in the hereafter. The money they get here at this cost really does not count. But for our jurists and ulema it leaves a big problem to explain to the devout how justice has been served?

@Ali: Don't hate the country. Change it's unfair laws. Please do not blame the victim's family, our law is an invitation for powerful criminals to intimidate or bribe the complainant to extract full amnesty. A victim has to "pursue" his own case, too bad if he/she is injured, sick, old, a child or simply too poor or uneducated - in that case, sorry, no justice, the law only listens to the powerful. Even if you win a case you will be subject to extortion and reprisals, the Police is simply too busy doing security guard duty for VIPs and their friends. That is when it is not misusing it's own authority or lining it's own pockets.

An out-of-court settlement worth Rs350 million was struck in the United Arab Emirates (UAE) before Shahzeb Khan's family pardoned. Shahzeb's family members have also been issued residency visas for Australia and were expected to depart for the country soon.
The court should not accept Shahzeb's parents application to pardon of the murderers and serve justice. This nation needs to set some examples for murderers so that crime can be stopped.

Our laws have set a precedent that in Pakistan, just like rapists, murderers are immune to consequences except that to get immunity a murderers family has to be capable of delivering believable lethal threats. This is not acceptable, why? No Remorse & Shame shown by convict. The criminal is non-repentant and so has a potential to repeat his rage on another innocent who can't even report an FIR. The case is not settled with the peaceful public and this will result in more and more retaliatory commitment and acceptance of general violence in coming days.

It shouldn't be even possible for anyone to arbitrarily forgive serious crimes, if justice is to be served every criminal should be treated under the same laws. Justice has to be universally applied to have any meaning. This primitive methodology of Qisas in the absence of effective witness protection is an open invitation to subvert justice by witness intimidation or bribery.

Please note: Sharukh Jatoi is not a son of a feudal lord, but of a contractor. If the family dreaded being threatened, they would not have pursued the case this far - putting everyone around them and involved in this case, in danger. However, I was happy to hear that the family cannot pardon the culprit if he has been convicted by the anti-terrorism court - which Shahrukh Jaoti has been. Lets keep our fingers crossed....

Pardoning the guilty is good. However this type of pardoning is very bad. Emperor Akbar used to pardon some guilty but would require them to go on a Hajj Pilgrimage to make sure that they are reformed persons. The parents of Shahzeb Khan should have done something similar, like sending the culprits on Hajj Pilgrimage and probably even requiring them to stay in Mecca for one year so that he really transforms to a good person.
The parents appear to be very good Muslims who follow the commands of Allaah and pardon the culprits in the name of Allah, after the cuprits have been judged and:

It is a very sad day indeed. I have no doubt in mind that Shahzeb's parents were forced to do so. We don't know but we can well imagine the kind of pressure they must have been put through. Just in case anyone thought the death penalty is an effective deterrent just look at that smug face getting away with murder. @Rotten_Justice: The Diyat law here is not at fault but the way it is used is. According to the Islamic law, Diyat is only applicable when someone kills a person accidentally. Here it was not the case, the murder was deliberate, thereby rendering this law inapplicable. The court should not accept Diyat as a pardon in cases like these..this will lead to an imbalanced society and a corrupt judicial system.

They are loop holes in the law as well, the court should have ordered to implement the court verdict within 24 hrs.

After all they are a powerful family, God knows what the victims family were put through to pardon this case when they were clearly winning. It is the feudal system which is at fault. Nevertheless in cases like these the court should abolish the law to pardon since the victim here is not Shahzeb Khan or his family, rather the citizens.

We are ashamed at this sort of Justice, it is simply injustice. Certainly the parents are forced to pardon him. What is this law that does not have the insight to ascertain the reality and do justice according to it, whereas it is just crippled without witnesses, who have the liberty to change their statements whenever they wish, or whenever they are bribed or threatened. This is a MUSLIM state, which was created in the name of ISLAM, in the name of ALLAH. These acts force us to became ashamed of ourselves, and our people and even our country.
Allah knows best I am happy because another family wont go through what shahzebs family went through and he probably didn't do it that's why Allah gave justice and poured it in shahzebs parents hearts to let him go. Pardoning a killer is not a right thing. The parents should not do this as killing to any person is a very grave crime. Pardoning a killer is also a great in-justice towards the victim.
Now all of Shahzeb's friends who organized the protests, participated in Tv shows, and especially those who were eye witnesses are in danger. Before they had the leverage of having Shahrukh in jail now they don't.
Who knows how much pressure the parents were under but this sets a bad precedent for the future. Now people will think twice before trying to be vigilant and demanding justice.
How can the case which is dealt under terrorism laws can be dropped just because the victim has forgiven the culprit ?

Pardon is the right of deceased kinship. One can not go against it, however it must be investigated that whether there was any pressure on Parents or they do it on their free will.

Not sure how would all the people would feel right now, who not only had struggled and made enemies with the rich in order to get the culprit convicted of his actions. If I was one of them I would have felt seriously let down by Mr & Mrs Khan's actions.
Shahzeb parents shouldnt have done this.. They would definitely have hurt Shazeb's soul after taking this decision. Feudels are like gods in Pakistan. Pakistan is like a jungle where there is no law and no rights. Only Jageerdars and Army has the right to live here and others are their slaves. I feel ashamed of being Pakistani.

I cannot understand that a father could pardon his son's murderer, Shame on this entire case! It was not simply another everyday shot and run case, it was a hope for all Pakistanis, specially the weak ones, everyone had their hopes tied to this case. Alas! Justice has been done. He was sentenced. His death could not have bring Shahzeb back. Also can lead to lifelong enmity of Shahzeb Family with Jatai's. Forgiving in the name of Allah is something much above than one can comprehend.

No wonder Shahrukh Jatoi always looked so confident whenever he was in court, even when death sentence was handed to him. He always knew.
Before people starting hating on the parents who forgave their son's murderer, just think that no parent would, unless the circumstances were really really bad. They have a daughter to think about. They have to live with this for the rest of their lives now, that they were so helpless that they had to forgive their son's killer.

Sharamnak. Case was no more a personal one but rather has a broader impact on society. If there was truly any Law in this land, this wouldn't have happened.

I always argued in favor of Qasaas/Deet as i thought it cant be misused..I was of view that a father whose son was murdered will never accept money in any circumstance and culprit will get the due punishment..Punishment will deter such incidents to happen in future thus bringing harmony/balance in society..but i was wrong..such loopholes must be elimanated from law..Anyone who is influential and have money can easily get away with crime..Only poor ppl will get to suffer the punishment...Elite can do whatever they want and our rotten justice system will for sure provide them protection for their ill deeds

Or let me put it this way.Should it be allowed?I would have thought that murder is crime not only agaisnt individual abut also agaisnt state.If start pardoning , no rich influential person will ever get punished.Ijtihad in Islamic law or clarification is called for. Especially when the person against which crime is commited, is no more.

After spending all that money of tax payers on this trail? they have the right to pardon them but court shud ask them to pay tax payers money wasted on this case.
