Written order in Jokhio murder case says IO has no authority to acquit anyone of charges

KARACHI:

The Judicial Magistrate Malir has issued a written order rejecting the report of the investigating officer (IO) in Nazim Jokhio murder case.

In the order, the court said that it is not the authority of the investigating officer to acquit anyone of the charge. The court has the power to accept or reject the report of the investigating officer.

The court excluded the names of six accused including Jam Karim from the case. The said accused were named in the FIR.

The written order said that the court has approved the removal of Jam Karim, Jamal Ahmed, Abdul Razzaq, Muhammad Khan, Muhammad Ishaq and Atta Muhammad from the case. The written order said that all the evidence and facts prove that the crime was committed. The investigation officer’s report to remove the name of Member Sindh Assembly, Jam Owais from the case is rejected.

Jam Owais is nominated and will have to face trial.

The court found involvement of accused Duda Khan, Niaz Salar, Muhammad Meraj, Muhammad Salim, Zahid and Muhammad Sommer in the crime. The inquiry officer’s report regarding the removal of names is rejected.

The three accused, Duda Khan, Niaz Salar and Muhammad Sommer had taken the deceased to the Jam House in the car.

As many as 16 accused have been naminated in the case.
