Davis Release: Petition dismissed due to absent lawyer

LHC dismisses application asking the court to determine which government functionaries facilitated Davis' release.

LAHORE:

The Lahore High Court (LHC) on Wednesday dismissed for non-prosecution an application which asked the court to determine which government functionaries had facilitated the early release of Raymond Davis by paying diyat, after the petitioner did not turn up.

The plea filed by Advocate Rana Ilmuddin Ghazi submitted that the trial judge had acted in haste. The advocate had alleged that Additional Sessions Judge Muhammad Yousaf Aujla had acted in violation of Shariah law as neither were all legal heirs identified nor was it ascertained whether all of them had made their statements without coercion and duress. He said that according to some media reports the government had paid diyat from the national exchequer.
