KARACHI: The Sindh High Court (SHC) has ruled that the acting vice-chancellor of the Federal Urdu University of Art, Science and Technology (Fuuast) will continue to hold the position of the vice-chancellor until a detailed judgement regarding the legality of the varsity senate's decisions was announced.

A division bench, headed by SHC Chief Justice Faisal Arab, passed this order while disposing of a miscellaneous application filed by the former university vice-chancellor, Dr Zafar Iqbal. On May 18, the SHC bench had dismissed a petition filed challenging removal of Dr Zafar Iqbal by the Senate.

On Thursday, he filed a miscellaneous application pleading the court to suspend its order for a period of two or three weeks in order to enable him to seek remedy from the Supreme Court. To support this contention, the petitioner cited examples of different judgements previously suspended by the court.

Additional attorney-general Salman Talibuddin, however, pointed out that in pursuance of the SHC's May 18 order, the acting vice-chancellor has taken over the charge of the university. He said the petitioner had been sent on leave and that as the interim order against his removal had also been vacated, subsequent events had taken place.

Dr Zafar cannot physically take over the charge of the vice-chancellor but his status shall remain that of a vice-chancellor until he avails remedy from the Supreme Court, maintained the federal law officer.

In view of the additional attorney-general's statement, the SHC bench observed, "In these circumstances, we cannot direct the acting vice-chancellor to hand over the charge to the petitioner. However, the petitioner shall continue to hold the status of the vice-chancellor on leave till such time this court delivers detailed reasons."
