Lack of courts to blame for delays: CJ

ISLAMABAD: Chief justice of Pakistan Iftikhar Muhammad Chauhdhry termed the curb on judiciary in 2007 as an unprecedented setback.

Addressing the national judicial conference in Islamabad the Chief Justice said that an independent judicial system is crucial for democracy. He cited lack of court rooms and judicial staff as a reason for delay in the disposal of cases.

Iftikhar Muhammad further stated that judiciary plays a pivotal role in providing justice to the masses adding that article 2-A guarantees the independence of the judiciary.

CHECK THE ACADEMIC QUALIFICATION PAPERS OF THE POLICE and publish their names.and get their clearence from prision records 2. computerize the police stations. 3. list all firs on web 4, computerize the applications for firs 5 computerize the criminal records with names of criminals so involved and their esentencs, 6.Refusal and continous refusal to lodge fir, should be backed by written replies to all correspondence. 4. no policitical appointments and promotions, henceforth. THE ENTIRE DELAYS AND LETHARGIC ATTITUDE F TE POLICE HAS MADE THE COURTS WORK MORE AND MORE CSSES FOR NO FAULT OF THE COURTS. MORE TO FOLLOW

Nighat Dad | 14 years ago | Reply Agreed that we need more courts for the disposal of pending cases but how about the courts and judges we have presently? Specially our courts of original jurisdiction or in simple language our lower courts. Are they providing the justice in real sense and are not really biased? I believe that judges are the part of the social order in which they live, reflecting many of its cultural standards and ethical norms but also many of its chauvinisms. Therefore it is more visible when it comes to gender parity guaranteed by the constitution of Pakistan. This is the fundamental requirement of the judges’ office to rise above any prejudice but in reality this does not take place. In fact judges at the lower level and sometimes at the higher level incline to strengthen discriminatory customary norms, rather than securing constitutionally guaranteed gender equality. Since the interpretation of law cannot be apart from the precise cultural milieu in which it is located, norms and accepted practices intensely accept the application and interpretation of law. In societies in which the concept of honor killing is socially legalized, the formal legal system will replicate this rationale__inspite of the textual provision of the law. The courts are loaded with the gigantic excess of cases and physical access to the courts is tremendously limited for those who live in the urban slums, rural and remote areas. Women are further impeded by poverty, inequalities and social taboos that expect women to endure rather then rise again injustice. If women seek legal redress against usurpation of her rights, the family honor perceived to be tarnished. So every device including emotional blackmailing is used to prevent her from resorting to litigation and I have no fear to say that male judges of the subordinate courts are biased against female litigants. Furthermore the basic structure of the dual formal legal system is biased in favor of the affluent and politically powerful and the law enforcing agencies suffer from lack of credibilty.
