Hamza Ahmed murder case: Police file charge sheet, suspects to appear before ATC on July 1

There are a total of 22 witnesses in the case.

KARACHI: The police has submitted the final charge sheet for the Hamza Ahmed murder case in an anti-terrorism court.

Law enforcers have submitted the charge sheet after inserting sections of the stricter anti-terror law into it on the instructions of the district prosecutor and consent of the special public prosecutor.

The court, while accepting the charge sheet on Monday, directed the investigating officer, Hameed Khan, to submit it to the trial court after the judge, who is on leave, returns for deciding the point of jurisdiction in the case.

Seventeen-year-old Hamza Ahmed was allegedly gunned down on April 27 by the security guard of another teenager, Shoaib Naveed, after an altercation between the two outside a restaurant in DHA on April 27.

According to Majeed Khoso, the complainant’s lawyer, the police submitted the charge sheet before Anti-Terrorism Court (ATC) -V judge. He was hearing the case as a link judge in the absence of the Ghulam Mustafa Memon of ATC-III. Khoso said that the judge accepted the charge sheet and ordered the suspects to appear before the court on July 1.

According to the charge sheet, Shoaib told the police that Hamza had threatened him for sending text messages to his friend, M*. Shoaib then told another friend, D*, who tried to resolve the matter amicably outside a cafe.

In his statement, Shoaib said that Hamza slapped him and in return, his guard, Amal Rahman - who is still at large - hit Hamza. The guard then opened fire at Hamza. After this, Shoaib, his driver and Amal fled from the scene. The charge sheet states that three eyewitnesses were present at scene.



Following the incident, the driver, Mushtaq, was arrested. The police said that during investigation, Mushtaq’s statements had matched those of Shoaib. Mushtaq told the police that Idrees, another driver hired by the family, had dropped Amal at Qayyumabad bus stop after the incident. In his statement, Idrees confessed that he had dropped Amal at the bus stop knowing that he had shot and injured someone.

The police obtained CCTV records from two cafes located at the site of the incident. The recordings turned out to be blurry and couldn’t aid the investigation much as the cameras were focused on the main gates and the parking lot, the police said in the charge sheet.

Earlier, on the court’s order, a medical board had examined Shoaib so that his age could be determined. It then declared that he was between 17 and 18 years of age. The charge sheet further revealed that the Deputy Inspector General Police (DIGP) had suspended and revered the previous Investigation Officer, Mulazim Hussain Bhatti, for carrying out investigations improperly.

The district public prosecutor had also disagreed with the interim charge sheet when it was submitted for scrutiny, says the charge sheet. In the final charge sheet, the current Investigating Officer, Hameed Khan, has shown that Shoaib is in jail in the despite the fact he has been released on bail. Khan presented the witnesses before the court who said the girl was the point of contention between Hamza and Naveed. The witnesses said that all friends had gathered to solve the issue but things got out of hand. They added that, Shoaib escaped while they took Hamza to South City Hospital, where he died.

The police stated that section 7 of the Anti-Terrorism Act was added because Hamza was shot dead by Amal on a main road. The suspects, Shoaib, Mushtaq and Idrees, didn’t stop Amal from doing so and also helped him escape, the police added.

The names of Shoaib’s father, Naveed Ahmed and Abid Hussain, the supervisor of the security company where Amal was employed, have been shown in the column of persons not sent up for trial as there was no concrete evidence against them. The police have included 22 witnesses in the case.
