Balochistan unrest: Army chief will be summoned, says CJ

Published: June 11, 2012

Chief justice takes notice of IG FC's press conference, says video will be sent to Army chief and defence secretary.

ISLAMABAD: Chief Justice Iftikhar Muhammad Chaudhry, while hearing the Balochistan law and order case on Monday, said that the Army chief will be summoned to the court to comment on the press conference held by Inspector General of Frontier Corps (FC) Major General Obaidullah Khattak.

The chief justice took notice of the press conference in which the IG FC blamed foreign agencies behind the unrest in Balochistan, and ordered for its video to be produced before the court. He added that the video will also be sent to the Army chief and the defence secretary.

The chief justice further added that the situation in Balochistan has already been unstable, while the IG FC is giving a press conference which is contrary to the court orders. He questioned if the IG FC is looking forward to a confrontation with the court.

Raja Irshad, the counsel for security agencies, told the court that the press conference was held to highlight the acts of foreign agencies, but the chief justice said that if there are foreign agencies present in Balochistan, then the responsibility lies with the federal government to deal with them.

The lawyer representing mobile phone companies told the court that the PTA has allowed issuing only five SIMs per person, and added that the companies have spent $30 million to provide a tracking system to agencies but they do not cooperate with the police.

Mr CJ it is easy to put blame on Army. Do you know since Army Operation is toned down in Balochistan BLA and other gangsters now a days are on a killing spree. No any other ethnicity other than Pashtoon and Baloch cannot live in Balochistan. Minorities are slaughtered like animals there. Today six people have been killed and in this month more than 20 from ethnic minorities in Balochistan have been gunned down. It seems BLA and Balochs have every right to kill based on a victim card but no one else have any right there in Balochistan.

But respectable CJ has to keep in mind that military brass since long enjoying unlimited freedom in its sphere. To put a stop might require lot of time. Let us see and hope COAS presents himself and offers some thing concrete for the satisfction of the court. Apparantly to me it looks a very remote possibility but one should always hope for the best.

Most Pakistanis see our Hon. CJ as the last hope to raise voice against injustice, corruption and lawlessness.

Hon. CJ we are with you always. As far as the cronies of these Mafias are concerned… they will be the first ones to run away from the country to Dubai or UK once we have PTI in power which will help establish free and independent NAB. That independent NAB that could hold any powerful person who is corrupt.

I honestly don’t know what people above want from Judiciary. If judiciary clamps down, they are called aggressors. If they let it go, they are accused of being an accomplice in human right violations.

I think the set of people who complain about human rights violations are different from the set of people who want judiciary to keep away from this case. Different groups have different objectives. In the end, judiciary has to decide what its role is within parameters of the constitution without being swayed by media reports one way or another.

I do not think the agencies can make that assumption. If there are a couple of bad apples in police who are leaking, they have to be made accountable. But to state that all the police is unrelianble and hence we will not co-operate is very strange. If the police of the country is not reliable then it amounts to a complete breakdown of law and order. Anther thing if the police which is an executive function asks for and fails to receive support from agencies which report to the army, can the government said to be sovereign?

CJ has not blamed the Army. He has just said that the court would call Army Chief, being chief of a responsible security forces, to come and tell what is a solution of Blochistan Crises.

Seeing the track record of Judiciary in letting the terrorists free after every arrest, a trust deficit has been developed between Law Enforcing agencies and the courts. Most of the Law enforcers considers it a futile effort to present the terrorists in the courts. Their Lawyer as quoted in news papers has said that FC is victim of Terrorists and Judiciary implying they both are on the same page. So the policy is let the Judiciary take out steam at them, but do what is right.
