Tribal areas: Detention beyond jurisdiction, says court

PHC asks petitioner seeking release of his father to approach the Frontier Crimes Regulation commissioner.

The Peshawar High Court (PHC) on Thursday asked a petitioner, seeking release of his father, to approach the Frontier Crimes Regulation commissioner as the matter is beyond the PHC’s jurisdiction.


Hashim Raza, counsel for Umer Khan, who has been put behind bars by the Khyber political administration, said the political agent charged Khan under sections 121 and 122 of the Pakistan Penal Code (PPC).

“Had the jurisdiction of the court been extended to the tribal areas, the situation would have been better,” said PHC Chief Justice Dost Muhammad Khan, while heading a divisional bench with Justice Waqar Ahmed Seth. The counsel told The Express Tribune that Khan along with his three sons and 15-year old grandson were picked up by the political administration in August 2010.

He said his grandson was released shortly after his arrest.
