Un-civil behaviour: Former PPP MPA’s bail application rejected

MPA absent from court, apex court has also taken suo motu notice of incident.

LAHORE: A division bench of the Lahore High Court on Tuesday rejected the bail application of former PPP MPA Aslam Madhyana in an FIR registered against him for torturing a school teacher and breaking both his legs.

According to the police, Madhyana and his accomplices attacked 60-year-old school teacher Nafees Ahmad Khan in Sargodha. Madhyana was granted interim bail by the LHC on March 5 and on Tuesday his lawyer asked the court for confirmation of the bail. According to legal experts, in bails matters it is necessary for the accused to appear in person before the court. The former MPA, however, was absent.

Madhyana’s lawyer said his client was not present when the incident occurred. He added that Madhyana was being implicated by the Punjab government which was trying to ruin his political career.

The investigation officer told the court that Madhyana was present when the incident occurred.

Punjab Prosecutor General Sadaqat Ali Khan said the accused had broken the legs of an elderly school teacher. He said Madhyana was a criminal, citing over 25 FIRs on matters including murder, theft and physical altercations that had been registered naming him.

After hearing the arguments, the bench, headed by Justice Najamul Hasan, rejected the bail application and ordered the police to arrest the former MPA.

Ahmad, who is under treatment, was brought to the court on a stretcher. Speaking to the media, he said he had not had much faith in the justice system.

“If the high-ups keep backing thieves, how will we, the common people get justice,” Ahmad asked.

The Supreme Court has also taken suo motu notice of the incident and has sought a report from all four provincial chief secretaries about steps taken to protect civil servants. They have been asked to file report by March 28.

Mirza | 12 years ago | Reply "citing over 25 FIRs on matters including murder, theft and physical altercations that had been registered naming him." These crimes must be relegated to less than slap according to the SC CJ. Even the blatant cold blooded murders are lesser crimes than the slap.
