The role of the Supreme Court

Letter December 14, 2011
History will pass final judgment on whether the CJ took decisions beyond powers granted by the Constitution.

SOUTH CAROLINA, US: This is with reference to Feisal Naqvi’s article “A step too far?”, published on December 14. In the context of the memogate hoopla, the reinstatement of the judiciary has left the question of the level of judicial activism allowed in the Constitution as something that the court itself has undertaken to decide.

History will pass the final judgment on whether the chief justice took decisions beyond the powers granted to the court by the Constitution.

However, in the meantime, wrong decisions can have a destablising effect on democracy and, if this happens, it will be a consequence Pakistan may have to live with.
