KARACHI: A Pannu Aquil couple that married of their own free will received legal backing when a court quashed an FIR against them.
A division bench of the Sindh High Court (SHC) comprising Justice Maqbool Baqar and Justice Muhammad Ali Mazhar took up Gulshan Bano’s case on Friday. She married Gul Muhammad after she was divorced by her first husband, Muhammad Soomar.
The couple ran into trouble when one of Gulshan’s close relatives, Muhammad Jumman, filed an FIR, accusing her of stealing gold and other valuables. The FIR also included accusations of kidnapping for zina.
According to Gulshan’s lawyer, Zakir Hussain Khaskheli, Gulshan and Soomar were divorced on May 21 this year and after all the paperwork was completed, she married again on September 14.
The couple belong to Buxo Selero village in Dadalo taluka of Pannu Aqil.
Muhammad Jumman argues that Gulshan’s divorce is fake and forged which means she is guilty of a double nikkah and is thus liable to be prosecuted under the relevant laws.
In their petition, the couple named the SHO of New Karachi, the home secretary and other officials as the fear there is a danger to their lives. They said that constable Irshad, Ali Sher, Muhammad Jumman and Muhammad Idrees are threatening them. They held a jirga which ordered for them to be killed.
The judges summoned the SHO of Preedy police station and asked him to protect the couple. The bench also quashed the FIR registered against them at Pannu Aqil police station.
