Seeking replies: PHC seeks reply for allotting land to Mardan varsity

PESHAWAR: The Peshawar High Court (PHC) issued notice to Khyber-Pakhtunkhwa government for allotting land to Women University, Mardan on Friday. The notice was issued as the land was originally purchased for expansion of Bacha Khan Medical College.

The court seeks a reply from provincial government by September 22. The notice was issued on a petition filed by Mardan district nazim Himayatullah Mayar through his counsel Khalid Mehmud.

The division bench, comprising of Justice Lal Jan and Justice Ibrahim, heard the petition. Mehmud argued that the provincial government has allotted 300 kanals of land to the varsity.

However, the land was originally allotted to medical college as the government planned to construct more departments.



Petitioner’s counsel argued the previous government purchased 991 kanals of land for Bacha Khan Medical College, Mardan. The land was handed over to Nes-Pak for expansion. He said the work on PC-1 was under way when the provincial government allotted 300 kanals piece of land to set up a university for women last month.

He urged the bench to declare allotment of land for Women University as null and void and hand over the land back to the medical college.

The bench, after hearing the arguments, issued notices to chief secretary, health department secretary, the BoGs of the medical college and communication and works department to file their replies.

In a separate case, the bench issued notice to secretary of ministry of state and frontier regions. The bench also summoned the political agent of Khyber Agency over the failure to implement court order in a non-appointment case. The bench summoned political agents after hearing a contempt of court petition filed by Abid Shah through his counsels Aminur Rahman and Kashif Shehbaz.

The petitioners’ counsel argued the PHC had ordered the political administration of Khyber Agency to recruit the petitioner as a clerk in the agency.

However, the order was not implemented. They added, PHC issued another order to implement the previous directive and appoint the petitioner as clerk on October 28, 2014. He said the administration also assured the court that they will implement the order. However, the court order was ignored and another candidate was recruited on the post, they argued.

The counsels adopted that a contempt of court notice was filed. As a result, the PHC issued a show-cause notice to the political agent on May 24. However, the PA only submitted a plain reply without implementing court order. They added repeatedly ignoring court orders was an offence. As a result, contempt of court proceedings should be initiated against the political agent.
