Election of nazims: PHC transfers petition to Darul Qaza

PESHAWAR: The Peshawar High Court transferred on Monday a petition challenging the election of the nazim and naib nazim of Wari tehsil, Upper Dir, to Darul Qaza in Swat.

The bench, headed by Justice Syed Afsar Shah, also extended a stay order against their elections. Petitioner Hussain Ahmad’s counsel, Barrister Waqar, told the court that the provincial government had recently amended certain sections of the local government act.

He said under the amended section, the Election Commission issued the election schedule for polls to elect the Wari tehsil nazim and naib nazim. “However, the amended sections have yet to be extended to the Provincially Administered Tribal Areas,” he added.

He contended these sections would be extended with approval from the governor and elections could not be held under the new amended laws. The bench, after hearing the arguments, transferred the case to Darul Qaza.
