Income tax: FBR gets month to decide Ayyan's appeal

The DHA issued on August 4, 2015, a notice for attachment of Ali's immovable properties on FBR’s request

The Sindh High Court gave a month to the Federal Board of Revenue (FBR) to decide an appeal filed by model Ayyan Ali in an income tax recovery case.


Headed by Justice Munib Akhtar, the division bench passed this direction while disposing of the appeal filed by Ali, who is already facing trial on currency smuggling charges.


Ayyan had taken the FBR to court for trying to confiscate her property in Defence Housing Authority (DHA) on default in payment of Rs18,857,500 worth of income tax in 2014. Her lawyers argued that FBR had served their client, who was in Adiala Jail, Rawalpindi, in June, 2015, a notice for recovery of the defaulted income tax under the Income Tax Ordinance, 2001. They added that while Ali appealed against the notices, FBR officials issued another notice, demanding her to clear the evaded tax. Before the revenue appellate authority could decide her appeal, the DHA issued on August 4, 2015, a notice for attachment of Ali's immovable properties on FBR’s request.


She pleaded to restrain the attachment of her properties and order the FBR appellate authority to decide her appeal against income tax demands.
